Membership Terms & Conditions

1. Membership Agreement

By purchasing or using a membership at Arctic Performance, you agree to abide by these Terms & Conditions. Memberships are personal, non-transferable, and non-refundable except as stated below. Arctic Performance reserves the right to deny or cancel membership for policy violations or safety concerns.

2. 24/7 Access Policy

Members receive 24-hour access to the gym unless access is suspended due to policy violations, maintenance, emergencies, or non-payment.

• Sharing your access key, code, or allowing “tailgating” entry is strictly prohibited.

• Allowing unauthorized access may result in immediate termination and a $250 unauthorized entry fee.

• Lost access keys may be replaced for a fee.

3. Gym Conduct Expectations

All members agree to:

• Train safely and responsibly

• Rerack weights and wipe down equipment after use

• Respect other members, staff, and property

• Avoid harassment, threats, or abusive behavior

• No drugs, alcohol, vaping, smoking, or illegal activity in the facility

Arctic Performance may suspend or terminate access for unsafe or inappropriate conduct.

4. Health & Safety

Members acknowledge that:

• Participation in fitness activities involves risk

• They are physically capable of exercising

• They will use equipment properly and responsibly

• They will not use the facility while impaired or medically restricted

In an emergency, call 911 immediately and notify the gym as soon as possible.

5. Assumption of Risk & Liability Waiver

By using the facility, members understand and accept all risks associated with exercise, including but not limited to injury, illness, accidents, equipment malfunction, and potential serious injury or death.

Members agree to release and hold harmless Arctic Performance, its owners, employees, and affiliates from any liability, claims, demands, or damages arising from use of the facility. Members use the gym at their own risk.

6. Security & Cameras

For safety and security, the gym utilizes video surveillance. Members consent to being recorded while inside the facility. No video is recorded in restrooms.

7. Age Requirements

Minimum age of 18 for unsupervised gym access. Minors may require parental approval or supervision.

8. Payments & Billing

Membership dues are automatically billed on a recurring basis. Members agree to keep their payment information current. Failed or late payments may result in suspended access and additional fees. Enrollment fees, annual fees, and key fees are non-refundable.

9. Membership Cancellation

Members may cancel their membership in accordance with the stated cancellation policy. Advance notice may be required prior to the next billing cycle. Early termination fees may apply depending on membership type. Medical, military, or relocation cancellations may require documentation.

10. Refund Policy

Membership fees are non-refundable except in the event of a billing error or permanent facility closure. Refunds will not be provided for non-use, schedule conflicts, dissatisfaction, or temporary closures.

11. Temporary Closures

The gym may temporarily close for maintenance, weather events, emergencies, holidays, or other reasons. Temporary closures do not automatically pause billing unless closures extend beyond a reasonable duration.

12. Personal Property

Arctic Performance is not responsible for lost, damaged, or stolen personal belongings. Members are encouraged to secure their items.

13. Personal Training

Outside personal training may be restricted unless approved by the gym. Members assume all risk when training independently.

14. Policy Updates

Arctic Performance may modify pricing, policies, and terms at any time. Updates will be communicated via website, email, or posted notice.

15. Governing Law

All membership agreements are governed under the laws of the State of Alaska.

By using Arctic Performance facilities, you acknowledge that you have read, understand, and agree to these Terms & Conditions.
